Terms of Service

These Terms of Service (“Terms”) govern your use of autopilot.prospectrdigital.com and your purchase of any product or service offered under the “Prospectr Autopilot” brand from Prospectr Marketing Inc. (“Prospectr,” “we,” “us”), a Minnesota corporation. By using the site or purchasing an Autopilot product, you agree to these Terms.
1. The Autopilot product
Prospectr Autopilot is an autonomous B2B outbound email service. Upon payment and brief submission:
- Setup ($1,000 one-time): Domain procurement (5-10 sending domains), inbox provisioning (50 inboxes), DNS/SPF/DKIM/DMARC configuration, warmup initiation, ICP intake processing, initial copy generation, Instantly workspace setup, and first sequence deployment.
- Monthly ($600/month flat): ICP data sourcing, copy generation, AI response nurturing, lead sorting and classification, inbox monitoring, deliverability management, and lead delivery to your inbox and dashboard.
Autopilot is AI-only at the delivery layer. No Prospectr human touches your account day-to-day. If you require human involvement, see the Managed Email tier.
2. Commitment and cancellation
Autopilot is month-to-month. You may cancel anytime from the customer portal. Your domains and inboxes remain provisioned through your paid-through date. You may request an export of remaining warmup time or migrate sending domains to your own Instantly account.
3. The 60-day guarantee
60-Day Lead Guarantee. Prospectr guarantees that the Customer’s Autopilot account will produce at least 50% of the lead volume estimated at signup (“Promised Volume”) within the first 60 calendar days of active service. If actual delivered leads (“Actual Volume”) are below 50% of Promised Volume at day 60, Customer may elect, within 30 days of day 60 (“Claim Window”), one remedy:
- (a) 50% service credit applied to the next monthly invoice, OR
- (b) termination of the subscription + a full refund of the one-time setup fee.
The Claim Window expires at day 90 (60 + 30). Lead quality, intent, and channel attribution are determined by the Customer in Prospectr’s standard reporting dashboard. Excluded from guarantee: months Customer paused, missed payment, or violated AUP §1.4.
4. Payment terms
All prices are in U.S. dollars. The $1,000 setup fee is charged at the time of Stripe checkout. The $600/month subscription begins immediately and bills monthly on the same date. Payment is processed by Stripe; Prospectr does not store full card information.
Refund policy: The $1,000 setup fee is non-refundable once we begin provisioning (approximately 4 hours after payment, when domain procurement starts). Monthly fees are pro-rated on cancellation from the cancellation date. If you cancel before domains are procured, the full setup fee is refunded.
5. Sales tax
Stripe Tax is enabled on all Autopilot transactions and automatically calculates applicable state and local tax based on your billing address. Prospectr Marketing Inc. is a Minnesota corporation; nexus states may include Minnesota and others depending on your location.
6. Data ownership
The sending domains procured for your Autopilot account are registered in your name. The Instantly workspace is yours. All lead data (prospect emails, replies, classifications) is yours. If you cancel, Prospectr retains no copy of your campaign data and no rights over your operational content. You own everything - this is the same sovereignty principle that powers our Sovereign product.
7. Deliverability and results
Prospectr does not guarantee a specific number of leads per month beyond the 60-day guarantee described in Section 3. Cold email deliverability depends on market conditions, prospect list quality, inbox placement at recipient ESPs, and other factors outside Prospectr's control. The 2,000:1 contact-to-inbox ratio and 20/day/inbox limits are enforced as a matter of SOP, not as a contractual metric.
8. CAN-SPAM and compliance
Autopilot is designed for US B2B outreach to business email addresses. All campaigns include legally required opt-out mechanisms and physical address footers per CAN-SPAM. Autopilot does not target consumer email addresses or EU residents. You are responsible for ensuring your target list complies with applicable law. Geographic targeting is set by you in your brief.
9. Acceptable use
You may not use Autopilot to:
- Target consumer email addresses (B2B only).
- Send content that is illegal, defamatory, or harassing.
- Promote products or services that violate US law.
- Circumvent opt-out requests or suppression lists.
- Impersonate another company or individual in your copy.
Violation of acceptable use may result in immediate campaign suspension without refund.
10. Intellectual property
The Prospectr SOP, Lead Pipeline SOP V4, copy frameworks, and sequence templates remain the intellectual property of Prospectr Marketing Inc. You receive a non-exclusive license to use the output (your specific campaign copy, sequences, and leads) in your business. You may not resell Prospectr's methodology or use it to build a competing product.
11. Limitation of liability
To the maximum extent permitted by law, Prospectr's total liability is limited to the amount you paid in the 12 months preceding the claim. In no event will Prospectr be liable for indirect, incidental, consequential, or punitive damages.
12. Governing law
These Terms are governed by the laws of the State of Minnesota. Disputes that cannot be resolved in good faith within 30 days will be settled by binding arbitration in Hennepin County, Minnesota.
13. Changes
Material changes will be posted on this page with a new “Last updated” date. Continued use after the change constitutes acceptance. Changes will not retroactively reduce rights tied to a purchase already made.
